CREIGHTON & PARTNERS’ MENTAL HEALTH TEAM

Who we are

The team is headed by Richard Charlton, who has over twenty years of experience and has been a member of the Law Society’s Mental Health Tribunal Panel since 1996. Richard has chaired the Mental Health Lawyers Association since 2001. He is a Senior Peer Reviewer for the Legal Services Commission and is the co-author and editor of the recent guide on good legal practice in mental health published by the Commission. He has over twenty reported cases to his name and broadcasts and teaches regularly. He has been consulted as an expert in mental health law by both parliamentary committees and the High Court. Other members of the team include solicitors and caseworkers with membership of the Law Society Mental Health Tribunal Panel.

What we do

We have the depth of experience and ability to assist in all areas of mental health law. Whilst many lawyers in this field confine their work to Tribunal representation only, Creighton & Partners have both the experience and the resources to take cases in all aspects of mental health law. The Team, which is supported by an experienced litigation team,   not only have extensive skills in Tribunal representation, but also wide-ranging experience of:

1. The Mental Capacity Act 2005 and the Court of Protection
2. Deprivation of Liberty decisions and assessments
3. Legal duties to provide aftercare and community care support
4. Legal challenges to the lawfulness of the decisions of local, health authorities and government departments.

We are already instructed by a number of public authorities.

Creighton & Partners are based in central London, convenient for both the Royal Courts of Justice and the Court of Protection. The team is always ready to consider agency work from other solicitors.

Training

The team is prepared to arrange tailored training at all levels at competitive rates. Courses cover all areas of the Mental Health and Capacity Acts as well as the appropriate application of community care law.
