We are able to advise and represent clients challenging the decisions of local authorities or health authorities as to a lack of services and support. The team’s work particularly covers the inappropriate closures of care homes and the abrupt transfer of residents. This has included work for the Official Solicitor on behalf of incapacitated clients.
Funding for such work is undertaken on a public funding (Legal Aid) basis subject to eligibility or on a private basis.
In February 2012 the Law Society Gazette reported on some of our work:
“A threat of legal action has blocked a local authority from moving eight mental health patients from care homes in the community. London firm Creighton and Partners began judicial review proceedings against the Council on the grounds that its decision was based on economic factors. The Council has said it has put the move on hold”
