What is Section 117 of the Mental Health Act?
Section 117 of the Mental Health Act enables certain categories of persons detained under the Mental Health Act to receive free aftercare on discharge from hospital. This can include accommodation as well as other services.
We have a vast array of experience in this area and are able to advise and challenge decisions made by Local Authorities which include charging residents for aftercare provision and discharging their duties under Section 117 of the Mental Health Act inappropriately.
We have successfully challenged the failure of several Local Authorities to pay for the service charges incurred by those eligible for Section 117 aftercare who are in specialist mental health accommodation.
Funding for such work is undertaken by public funding (legal aid) or on a private basis.
