The importance of aftercare information in the First-tier Mental Health Tribunal

Creighton & Partners' Mental Health team have been involved in a significant case regarding aftercare provided to patients. Creighton & Partners represented AM, a patient detained in hospital under the Mental Health Act 1983, in an appeal on a decision by the First-tier Mental Health Tribunal based on the fact that insufficient information had been provided on aftercare available to AM in order to make an informed decision with regards to continued detention in hospital.

The case is AM v West London Mental Health Trust and Secretary of State for Justice, [2013] EWCA Civ 1010
